Terms of Service

These Terms of Service govern your access to and use of the websites, applications, portals, tools, content, services, and related features operated by Radiant Peak LLC.

By accessing or using the Radiant Peak platform, creating an account, connecting a third-party account, or clicking to accept these Terms, you agree to be bound by them.

If you do not agree to these Terms, you may not access or use the platform.

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Radiant Peak platform.

By using the platform, you represent that the information you provide is accurate, that you meet all eligibility requirements, and that your use of the platform does not violate any applicable law, contract, or third-party requirement.

Radiant Peak may provide services and features related to creator development, TikTok Shop activity, affiliate collaborations, product samples, training, rewards, account tools, brand partnerships, seller services, community support, analytics, and agency operations.

Available services may vary by user, account type, location, platform eligibility, agency relationship, authorization status, and business needs.

Radiant Peak may add, modify, suspend, restrict, or discontinue any feature or service at any time.

You may be required to create an account or connect an eligible third-party account to use certain features.

You agree to:

• Provide accurate and current account information
• Keep your contact information updated
• Protect your login credentials and connected accounts
• Notify Radiant Peak promptly of suspected unauthorized access
• Use only accounts you own or are authorized to manage
• Accept responsibility for activity performed through your account

Radiant Peak may suspend access when account activity appears fraudulent, unauthorized, unsafe, or inconsistent with these Terms.

Certain features may require you to connect or authorize a TikTok, TikTok Shop, Discord, or other third-party account.

Your use of those services remains subject to the separate terms, policies, eligibility requirements, and enforcement decisions of the applicable third-party provider.

Radiant Peak does not control TikTok or other third-party platforms and cannot guarantee continued access, account standing, feature availability, authorization approval, product availability, sample approval, traffic, sales, commissions, or platform performance.

You are responsible for complying with all rules applicable to your connected accounts, content, affiliate activities, advertising, product claims, and commercial communications.

Access to certain creator tools may be limited to users who are verified as current Radiant Peak creators or otherwise approved by Radiant Peak.

Login, authorization, application submission, or access to a public webpage does not guarantee acceptance into Radiant Peak, continued agency affiliation, access to all tools, or eligibility for a particular opportunity.

Radiant Peak may verify eligibility using its internal records, connected platform information, account identifiers, creator rosters, or other reasonable methods.

Product samples and affiliate collaborations may be offered by sellers, brands, TikTok Shop, or other third parties. Radiant Peak does not guarantee that any request will be approved, shipped, delivered, or remain available.

Creators are responsible for reviewing and complying with all sample, collaboration, posting, disclosure, content, and deadline requirements.

You are responsible for the accuracy, legality, and quality of content you publish and for clearly disclosing sponsored, gifted, affiliate, or compensated relationships when required.

Radiant Peak may provide reminders or tracking tools, but those tools do not replace your responsibility to monitor official platform deadlines and obligations.

Radiant Peak may operate rewards, Tokens, incentive programs, milestones, contests, giveaways, or promotional opportunities.

Unless expressly stated otherwise, Radiant Peak Tokens and similar internal reward units:

• Are promotional accounting units and not legal currency
• Have no guaranteed cash value
• Are not transferable between users
• May be subject to expiration, verification, and program rules
• May be adjusted to correct errors, reversals, fraud, or invalid activity
• May not be purchased, sold, traded, or exchanged outside approved programs

Specific reward programs may include additional terms, eligibility rules, redemption requirements, taxes, deadlines, limits, or exclusions.

Radiant Peak may modify or discontinue a rewards program, but will not intentionally misrepresent an earned reward or apply undisclosed requirements retroactively.

Radiant Peak does not guarantee followers, views, engagement, approvals, samples, sales, orders, gross merchandise value, commissions, revenue, profitability, platform growth, or any other business result.

Results vary based on factors outside Radiant Peak's control, including content quality, product demand, creator activity, audience behavior, seller performance, pricing, inventory, platform algorithms, policy changes, and market conditions.

Any examples, projections, training materials, case studies, or past results are illustrative and are not promises of future performance.

You may not use the platform to:

• Violate any law, regulation, contract, or platform policy
• Impersonate another person or misrepresent your affiliation
• Submit false, misleading, fraudulent, or manipulated information
• Access another user's account or data without authorization
• Interfere with platform operation, security, or availability
• Attempt to bypass authentication, access restrictions, or rate limits
• Upload malware, harmful code, or automated attacks
• Scrape, copy, reverse engineer, or exploit the platform unlawfully
• Harass, threaten, discriminate against, or exploit other users
• Use the platform to facilitate fraud, deception, or illegal commerce
• Abuse sample, reward, referral, or promotional programs

You retain ownership of content and materials you submit to Radiant Peak, subject to any rights held by third parties.

You grant Radiant Peak a limited, non-exclusive license to host, process, reproduce, display, and use submitted content as reasonably necessary to provide the platform, administer services, communicate with you, and fulfill your requests.

You represent that you have all rights necessary to submit the content and that its use by Radiant Peak as described in these Terms will not violate another person's rights.

The Radiant Peak name, logos, branding, website, platform design, software, tools, documentation, graphics, and original materials are owned by or licensed to Radiant Peak LLC.

Except as expressly permitted, you may not copy, modify, distribute, sell, license, reproduce, or create derivative works from Radiant Peak materials without written permission.

You agree that Radiant Peak may send service-related communications concerning your account, security, applications, samples, rewards, opportunities, policy updates, or platform operation.

Where required, promotional communications will include an appropriate method to unsubscribe. You may still receive necessary account, security, transactional, and legal notices.

You may stop using the platform at any time and may request account closure by contacting Radiant Peak.

Radiant Peak may restrict, suspend, or terminate access when reasonably necessary to:

• Protect the platform, users, Radiant Peak, or third parties
• Investigate suspected fraud, abuse, or unauthorized activity
• Comply with law or third-party platform requirements
• Address a violation of these Terms or another agreement
• Respond to the end of an agency or business relationship
• Discontinue or materially change a service

Termination does not eliminate obligations, liabilities, or provisions that by their nature should survive termination.

The platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

Radiant Peak does not warrant that the platform will be uninterrupted, error-free, secure, compatible with every device, or continuously available.

Information and training provided through the platform are general business and educational resources and are not legal, tax, financial, accounting, medical, or other licensed professional advice.

To the fullest extent permitted by law, Radiant Peak LLC and its owners, personnel, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the platform.

This includes losses involving revenue, profit, data, goodwill, opportunities, platform access, account enforcement, product samples, commissions, business interruption, or third-party conduct.

Some jurisdictions do not permit certain liability limitations. In those jurisdictions, the limitations will apply only to the maximum extent permitted by law.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Radiant Peak LLC and its owners, personnel, contractors, and affiliates from claims, damages, losses, liabilities, and expenses arising from:

• Your violation of these Terms
• Your unlawful or unauthorized use of the platform
• Your content, product claims, promotions, or communications
• Your violation of another person's rights
• Your violation of TikTok or another third-party platform's rules

Radiant Peak may update these Terms as the platform, services, legal requirements, or business practices change.

Updated Terms will be posted with a revised effective date. Material changes may also be communicated through the platform, email, or another reasonable method.

Changes will not be used to secretly impose materially different data practices or unfairly alter completed transactions.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where another law must apply.

Any dispute that is not resolved informally will be handled in a court of competent jurisdiction, subject to any applicable mandatory consumer protections.
